These General Terms and Conditions apply to all contracts between:
Picari Studio – Zaffarano & Kasdepke GbR
Haydnplatz 4
76133 Karlsruhe
– hereinafter referred to as “Picari Studio” –
and the respective client.
Deviating terms of the client are not recognised unless their validity has been expressly agreed to in writing.
The subject of the contract is services in the field of photo, video, design and content production, as well as related creative services. The specific scope of services is set out in the respective offer or order confirmation.
The client shall provide all information, content and materials required for the execution of the project in good time. Delays caused by a lack of cooperation shall not be the responsibility of Picari Studio.
The prices agreed in the offer shall apply. Invoices are payable within 14 days of the invoice date without deduction. In the event of late payment, Picari Studio reserves the right to charge default interest in accordance with statutory provisions.
All content created by Picari Studio, in particular photo, video, design and media productions, is subject to copyright. Unless otherwise agreed, simple usage rights are transferred to the client only after full payment has been received. Any editing, transfer or publication beyond the agreed scope requires the written consent of Picari Studio.
Picari Studio is entitled to use completed work for self-promotion, portfolio purposes and publication on its website and social media channels, unless expressly agreed otherwise.
Picari Studio shall only be liable for damages resulting from intentional or grossly negligent conduct. To the extent permitted by law, no liability is accepted for data loss, technical failures or loss of profit.
Picari Studio accepts no liability for delays or failures to perform due to force majeure. This includes, in particular, natural events, actions by public authorities, illness or technical disruptions beyond Picari Studio's control.
The laws of the Federal Republic of Germany shall apply. Should individual provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. To the extent permitted by law, the place of jurisdiction is Karlsruhe.
